Welcome to www.theartistedition.com. The www.theartistedition.com website (the “Site”) is comprised of various web pages operated by The Artist Edition Inc. (“The Artist Edition”). When entering www.theartistedition.com (the “Site”), you agree to the following Terms. If you do not agree to these Terms, please do not use this Site. The Artist Edition Inc reserves the right, at our complete discretion, to change, modify, add, or remove portions of these Terms at any time. Please read these terms carefully, and keep a copy of them for your reference.

Your Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that The Artist Edition is not responsible for third party access to your account that results from theft or misappropriation of your account. Nomad and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

Intellectual Property Rights/Unlawful or Prohibited Use

The Site is owned by The Artist Edition. The content on the Site is owned by The Artist Edition or its licensors. The information is protected by intellectual property and market laws. As a condition of your use of the Site, you warrant to The Artist Edition that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of The Artist Edition and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of The Artist Edition or our licensors except as expressly authorized by these Terms.

Cancellation of an Order

As a customer of The Artist Edition You have the right to cancel a purchase without giving reasons in accordance with the rules on withdrawal set out in the Distance and Off-Premises Contracts Act within EU. Your right to cancel an order is valid for 14 days from the day You received the goods.  Upon exercise of the right to cancel an order, You will pay for the return shipping and You are responsible for the return back to The Artist Edition. The return shall be sent without undue delay and at the latest within 14 calendar days from exercise of the right to cancellation.  The merchandise must be well packaged, in perfect condition and in the original box.  The right does not apply to limited edition prints, frames made on order, prints/frames and goods produced according to customer specifications or otherwise have been clearly personalized.  In connection with an order of goods for which the right of withdrawal does not apply, You will receive clear information on this from The Artist Edition.  If You wish to cancel a purchase made through the Site, You should, before the withdrawal period has expired, send an email to The Artist Edition in the manner specified here. You must enter Your name, address and other relevant information such as order number, invoice number and name of the item in the message.  Once You cancel Your purchase, the amount You have paid for the product will be refunded to You (this does not include compensation for any increased costs of delivery if You have chosen not to use our standard delivery option). The amount to be repaid to You will be paid to You by The Artist Edition as soon as possible, but no later than within 30 days from the date when your items are back at our warehouse. The refund will be done via the payment option You chose when buying the product, provided that, unless otherwise agreed or that there are any obstacles with such reimbursement. You will not be affected by any fees or charges due to Your choice of payment method. The provisions set forth herein do not limit any applicable statutory rights.

Indemnification

You agree to indemnify, defend and hold harmless The Artist Edition, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys’ fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. The Artist Edition reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with The Artist Edition in asserting any available defenses.

Changes to Terms & Conditions

The Artist Edition reserves the right, in its sole discretion, to change the Terms under which hellonomad.com is offered. The most current version of the Terms will supersede all previous versions. The Artist Edition encourages you to periodically review the Terms to stay informed of our updates.
